What Is a DOT SAP Evaluation?

A DOT SAP evaluation is a federally required assessment for safety-sensitive employees who violate U.S. Department of Transportation (DOT) drug and alcohol testing regulations. If a commercial driver fails a DOT drug test, refuses testing, or violates alcohol testing rules, they must complete the DOT SAP program before returning to safety-sensitive duties.

The evaluation must be conducted by a qualified Substance Abuse Professional (SAP) who follows guidelines established under 49 CFR Part 40. The SAP evaluates the employee and determines the necessary education or treatment required before the return-to-duty process can begin.

FMCSA Clearinghouse & SAP Program

The FMCSA Drug and Alcohol Clearinghouse is a federal database that tracks DOT drug and alcohol violations for CDL drivers. Employers are required to review this database before hiring CDL drivers and conduct annual checks thereafter. 

If a violation is listed in the Clearinghouse, the driver cannot legally perform safety-sensitive duties until the SAP program is completed. An SAP evaluation is the first and most critical step in resolving the violation.

Who Must Complete the DOT SAP Program?

Any employee in a safety-sensitive position regulated by the Department of Transportation must complete the SAP program after a drug or alcohol violation. This includes:

    Initial SAP Evaluation

    The driver meets with a qualified Substance Abuse Professional who evaluates the violation under 49 CFR Part 40.

    Education or Treatment

    The SAP recommends appropriate education or treatment programs based on the clinical evaluation, without assumptions.

    Complete Recommendations

    The driver must complete the full recommended program as directed by the SAP.

    Follow-Up SAP Evaluation

    A second evaluation confirms the driver has successfully complied with all SAP recommendations.

    Return-to-Duty Drug Test

    The driver must pass a DOT-observed drug test before returning to safety-sensitive duties.

    Follow-Up Testing Program

    After returning to duty, the driver must complete random follow-up drug and/or alcohol testing with their employer for ongoing monitoring, as directed by the SAP.

    DOT Violations That Require the SAP Program

    Drivers enter the FMCSA Clearinghouse after several types of violations. Each requires full completion of the SAP program before returning to work.

    Positive Drug Test

    Marijuana, cocaine, opioids, PCP, or methamphetamine detected above DOT thresholds.

    Alcohol Violation

    Alcohol concentration of 0.04 or higher during or just before safety-sensitive duty.

    Refusal to Test

    Refusing to complete a DOT drug or alcohol test is treated as a positive result

    Actual Knowledge Violation

    Employer has direct knowledge of prohibited drug or alcohol use.

    Adulterated or Substituted Test

    Tampering with or altering a drug test specimen.
